I'm not certain what the law is in New Zealand, but in the U.S. this photo could be an invasion of privacy even though it is shot in public.  Be careful.

I thought, if a person is in public, the law in the US was that you were essentially consenting to be photographed - that it was only in private that invasion issues were a problem.  Otherwise, street photography would be dead.

There are certain instances where there is still expectation of privacy.  One cannot take upskirt photographs of women just because they are in public.  I am not certain, but my guess is that this lady was not intending to show her bare bottom, it looks like it was an accident.  The photographer should have a moral compass and even though he captured this image, it doesn't give him rights to show it, or keep it.  If he was waiting for the air through the grates to push up skirts at this location, then there is something wrong with that.

Upskirt shots are illegal in places like public bathrooms - places where people seclude themselves and can expect a reasonable degree of privacy.  But outside of that, they are not illegal.  Whether they're immoral is another question.  Wearing a short skirt/dress on a windy day - and I say this as a woman who wears short skirts/dresses sometimes - is risky, as far as accidentally revealing yourself, so on some level, you kinda have to be okay with that.  I don't believe it should be legal to sexually harass a woman for such a thing - but technically, if you end up in a photo - and let's be honest, the photo is pretty much a lucky shot, I don't think there was that much "intention" behind capturing the upskirt - then there's nothing, legally, a woman can do about it. In fact, in the US, a woman can get raped, and the judge can decide she was dressed too provocatively, and she could lose her rape/sexual harassment case. Welcome to being female in the US.  Of course, as you say, the ethics of posting such a photo is another issue altogether.

The link you provided was about taking underwater photographs of children in bathing suits, not taking upskirt images of women on the street.  "The ruling does not address the constitutionality of the statute's latter part that involves the broadcast or transmission of images."

You're point about the swimsuits is, what exactly?  If it's legal to take an upskirt photo of a person in a swimming pool, than it's legal to take one in the street - which is what the court ruled - ANY UPSKIRT PHOTO IS LEGAL IN TEXAS, and many other states. I can see this is one of those internet endless loop arguments, so this is my last post on this subject, but you should stop trying to prove you're right, and try researching your opinion by googling "legality of upskirt photos" and you'll see that state courts so far have deemed public upskirt photos are legal.  There are certainly NO laws regulating against street photography of this nature in the US on the FEDERAL level AT ALL, so it's inaccurate, and even immoral, to say there is. I think it's unethical for you to spread the idea that women in the U.S. have access to legal protections they don't have. Women should be aware if they're wearing a skirt in public and the wind flies up, they are NOT Constitutionally protected from having someone take a photo of that and post it online.  If we want laws against this, than we need to actually do something to make that happen.  Too many people think the internet is regulated in ways that it isn't, and it's not helping anyone to act like we're legally protected in ways that we aren't.  That's unethical, in my opinion.

I know you are, but you are also picturing me as a pervert here and it's not cool especially because I haven't seen that discussion behind my back until now. I respect you have a right to have a different opinion but you should also know that I never intend to offend people with my photos and I'm always happy to take off the photo from the internet if someone on the actual photo asks for it. I know there are people who might not like this kind of work, but that's another face of the genre and I'm sure that there is much worse stuff out there than this. Every street photographer has their own line in terms of ethics and morality and it is their conscience and responsibility to decide whether it is moral or not. In regards to this photo, I believe this spot in Lisbon is kind of an "attraction" over there and I'm sure there's thousands of photos like that all over the internet. Anyways, sorry if I caused you any harm by sharing this with outside world :)

The same thing happened to me yesterday.. except the wind wasn't blowing.. my skirt was caught behind my bag for I don't know how long. 
Til someone tapped me on the shoulder to tell me. 
It was so embarrassing.
